Agreement to Terms

Welcome to SHUBINDIA AD WORKS. These Terms and Conditions govern your access to and use of our website (https://www.shubindiaadworks.com), products, and services. By browsing the site, submitting an enquiry, or engaging us for an outdoor advertising or newspaper campaign, you agree to be bound by these Terms and all applicable laws of India. If you do not agree with any part, you must not use our services.

Legal Entity

SHUBINDIA AD WORKS is a Pune-based proprietorship operating since 2013, registered with the Government of India: GSTIN 27BAJPJ1192E1ZT and MSME Udyam Registration UDYAM-MH-26-0510774. Registered office: HYDE PARK, Shop No.66 D Wing, Vastushree Complex, Market Yard, Pune 411037, Maharashtra, India.

Services Description

We provide end-to-end outdoor and print advertising services across Pune, PCMC, Mumbai, Maharashtra and pan-India:

  • Hoarding and billboard advertising (premium, standard, and value-priced inventory)
  • Bus shelter advertising, transit branding, and metro station placements
  • Newspaper insertions: Times of India, Sakal, Lokmat, Maharashtra Times, Indian Express, Loksatta, Punyanagari
  • Classified advertising and display ads in regional and national dailies
  • Digital OOH and LED-display placements on high-traffic corridors
  • Cinema, airport, and railway media planning
  • Creative design, brand identity, and campaign artwork
  • Media buying, planning, and post-campaign reporting

Account & Order Terms

When you place an order — by signed Insertion Order, email confirmation, or our online campaign builder — you confirm that all client information (entity name, GSTIN, registered address, brand brief, target locations) is accurate. You are responsible for the legality of the creative content you supply: it must comply with the Advertising Standards Council of India (ASCI), municipal hoarding guidelines, and any sector-specific regulator (RBI for financial-services ads, FSSAI for food ads, etc.).

Orders, Pricing & Payments

  • All prices are quoted in Indian Rupees (INR) exclusive of GST unless otherwise stated.
  • Quotes are valid for 14 days from issue date; thereafter inventory and rates are re-quoted.
  • Standard payment terms: 100% advance for under ₹1 Lakh; 50% advance + 50% before campaign start for ₹1-5 Lakh; milestone billing for ₹5 Lakh+.
  • GST at the prevailing rate (currently 18% for advertising services under SAC 998361) is charged in addition.
  • Order acceptance is subject to inventory confirmation from the site owner or publisher.

Prohibited Uses

You agree not to use our services to publish creative that: violates Indian law (IT Act 2000, Cable TV Rules, ASCI Code), infringes third-party trademarks or copyrights, contains obscene/defamatory/political-electioneering content outside the Election Commission framework, advertises banned substances (tobacco, certain alcohol categories, surrogate-advertised products), or makes unsubstantiated health / financial claims. Violation may result in immediate campaign termination without refund and reporting to the relevant authority.

Intellectual Property

All website content — text, photos, schemas, logos, code — is the property of SHUBINDIA AD WORKS and protected under Indian copyright law. Creative artwork prepared by us for your campaign remains our intellectual property unless full IP transfer is contracted separately; we grant you a non-exclusive license to use that artwork for the contracted campaign duration. Creative artwork supplied by you remains your IP; you grant us a limited license to use, display, and distribute it solely to execute your campaign.

Limitation of Liability

To the maximum extent permitted by law, SHUBINDIA AD WORKS is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim. We are not liable for revenue lost due to delayed campaign launch caused by force-majeure events, government-mandated takedowns, or publisher-side production issues.

Indemnification

You agree to indemnify and hold harmless SHUBINDIA AD WORKS, its proprietor, employees, and vendors from any third-party claims, statutory penalties, or legal costs arising from (a) your supplied creative content, (b) your violation of these Terms, or (c) your violation of any third-party rights including intellectual property.

Governing Law & Dispute Resolution

These Terms are governed by the laws of India, with exclusive jurisdiction in the courts of Pune, Maharashtra. Disputes are resolved in the following order: (1) good-faith negotiation within 30 days; (2) mediation in Pune; (3) binding arbitration under the Indian Arbitration and Conciliation Act 1996, sole arbitrator appointed by mutual consent; (4) litigation in Pune district courts.

Modifications & Contact

We may modify these Terms at any time; material changes are notified to active clients by email and posted with a fresh "Last Updated" date below.
